Newcastle Research terms of use
Last updated: 9/13/2026
Welcome to the Newcastle Research website. Please read these Terms & Conditions (the "Terms") carefully. By accessing or using this site, you accept these Terms in full, without limitation or qualification. If you do not agree to these Terms, please do not use this site.
In these Terms, "Newcastle Research," "we," "us," and "our" refer to Newcastle Research LLC, a New Hampshire limited liability company, and "you" refers to any person who accesses or uses this site.
1. About this site and our content
Newcastle Research is an independent research and advisory firm. The materials on this site — including research, analysis, frameworks, commentary, articles, and related content (collectively, the "Content") — are published for general informational purposes only. They reflect our independent opinions and professional judgment as of the date of publication.
The Content is general in nature and is not prepared with regard to the specific circumstances, objectives, or needs of any particular reader or organization.
2. No professional or advisory relationship
Your access to or use of this site does not create a consulting, advisory, fiduciary, or other professional services relationship between you and Newcastle Research. Reading the Content does not entitle you to advice tailored to your situation and creates no obligation on our part to monitor any market, vendor, or topic, to update any Content, or to notify you of any change.
Advisory, research, and training engagements are governed exclusively by separate written agreements. Nothing on this site constitutes an offer to enter into such an engagement, and no engagement arises until a written agreement is signed by both parties.
3. Research opinions and forward-looking statements
Our research and commentary represent our opinions, not statements of fact, and are not guarantees of any future outcome. Reasonable people may disagree with our analysis, our methods, or our conclusions.
Although we prepare the Content using sources and information we believe to be reliable, we do not independently verify all such information, and we make no representation or warranty as to its accuracy, completeness, usefulness, or timeliness. Content — including any opinions, forecasts, market assessments, or forward-looking statements — is subject to change without notice, and we assume no obligation to update or amend it.
Any reference to, or discussion of, a specific vendor, product, or organization is provided for analysis and illustration only and does not constitute an endorsement or recommendation. Any decision you make, or action you take, in reliance on the Content is at your own risk. You are responsible for independently evaluating the Content in light of your own circumstances and, where appropriate, seeking your own professional advice.
4. Independence and disclosures
Newcastle Research values its independence, and our published research reflects our own judgment. At the same time, we work across the HCM ecosystem — including buyer-side advisory and voice-of-customer research, as well as sales training and coaching for HCM vendors — and we may therefore have current or prior commercial relationships with organizations discussed in our Content.
Where Content is commissioned, sponsored, or otherwise produced under a paid engagement, we will identify it as such. The existence of a commercial relationship does not entitle any party to influence our independent analysis or conclusions in our non-commissioned research.
5. Intellectual property
Unless otherwise stated, the Content on this site, together with its selection and arrangement, is the property of Newcastle Research and is protected by copyright and other intellectual property laws. "Newcastle Research" and our associated names, logos, and marks are our trademarks. All other trademarks referred to on this site are the property of their respective owners.
Nothing on this site shall be construed as granting, by implication, estoppel, or otherwise, any license or right to use any copyright, trademark, or other proprietary interest of Newcastle Research or any third party. The Content may not be copied, reproduced, republished, uploaded, posted, transmitted, distributed, or used to create derivative works, in whole or in part, without our prior written consent — except that you may download, display, and print a single copy of materials for your own personal, non-commercial reference, provided that you do not modify the materials in any way and you keep intact all copyright, trademark, and other proprietary notices.
If you wish to quote, cite, or republish our Content — for example, in a presentation, article, or vendor communication — please contact us for permission.
6. Third-party links
This site may contain links to websites, services, or resources operated by others. We provide these links for convenience only. We do not control, and are not responsible for, the content, accuracy, or practices of any third-party site or service, and a link does not constitute an endorsement. Any use you make of a third-party site or service is at your own risk and subject to that third party's terms.
7. Disclaimer of warranties
This site and all Content are provided "as is" and "as available," without warranty of any kind. To the fullest extent permitted by law, Newcastle Research disclaims all express and implied warranties, including, without limitation, the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranty that the site or Content will be accurate, complete, current, uninterrupted, secure, or free of errors or harmful components.
8. Limitation of liability
To the fullest extent permitted by law, in no event will Newcastle Research, or its members, employees, contractors, or service providers, be liable to you or any third party for any direct, indirect, incidental, special, exemplary, consequential, or other damages — including, without limitation, lost profits, business interruption, or loss of data — arising out of or in connection with this site, any Content, any site or service linked from this site, or your use of or inability to use any of the foregoing, regardless of the form of action and whether in contract, tort (including negligence), strict liability, or otherwise, even if we have been advised of the possibility of such damages.
9. Your submissions
Unless expressly stated otherwise, any information you submit through this site (for example, through a contact or subscription form) will be treated as non-confidential and non-proprietary. You represent that you have the lawful right to submit such information. Because of the open nature of the Internet, we recommend that you not submit any information you consider confidential through this site. Confidential information should be exchanged only under a separate written agreement.
10. Unsolicited idea submissions
We welcome inquiries about working together, but we do not accept unsolicited idea, proposal, or business submissions outside of an established, written business relationship. Without such a relationship, we cannot and do not treat any submission as confidential. Any idea disclosed to us outside a pre-existing, documented confidential relationship is non-confidential, and we may develop, use, or disclose similar ideas without any obligation or compensation to you. Please do not send us unsolicited confidential or proprietary ideas through this site.
11. Your responsibilities
You are responsible for complying with the laws of the jurisdiction from which you access this site, and you agree not to access or use the Content in violation of those laws. You agree not to use this site in any way that is unlawful, or that could damage, disable, or impair the site or interfere with any other party's use of it.
12. Governing law
These Terms, and any dispute or claim arising out of or relating to them or to this site, are governed by the laws of the State of New Hampshire, without regard to its conflict-of-laws rules. You agree that any such dispute or claim will be subject to the exclusive jurisdiction of the state and federal courts located in New Hampshire, and you consent to the personal jurisdiction of those courts.
13. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the site after any change constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.
14. Contact
Please contact us with any questions about these Terms, or requests to reproduce or cite our Content.
